Respect of the EULA terms (refund of OS)

On every EULA from Windows OS, it's clearly write that a consumer who disagree with the term of the EULA contract can be refunded, but it's not possible with Dell's computer.

I can not support Microsoft. I will not buy hardware from any company that ships windows, without the option of removal, on a system.

A huge precent of microsoft's business is due to windows selling on every system by default, without the option to remove it. This is anti-free-trade in my opinion. The only reason people use windows over more secure or easy solutions is that it comes with the system and people are too lazy to use anything not pre-installed.

Dell sells Window computers, they are legallt required to fulfill this requirement. I have heard from several people that they have, in fact, recieved refunds after being offered Dell vouchers instead.

Dell should see VERY clearly that there are thousands of customers who reject Windows, or in some cases, all non-Free software. I hope Dell will officially support a Free Software operating system, but if they won't, at least don't make it hard for people who want to very CLEARLY exercise their contractual right to have the Windows license fee refunded.

I've decided that I've had enough with Windows after having to deal with my brothers PC, which he found became infested with spyware and got turned into a porn fileserver without his knowledge, all despite being behind a hardware firewall, having a software firewall and virus scanner installed, and applying all the Windows updates as they came out. I can only guess that his continued use of IE was the vector by which his system became infected.

I'll never buy another computer from Dell or any other vendor if it comes pre-loaded with Windows. I might buy one from a vendor if I knew they respected the EULA and would provide a refund for not using Windows.

Didn't the Anti-Trust case prove that Microsoft was barred from requiring OEM's from installing Windows on ALL machines? If your no longer hooked into putting Windows on all machines, give an option to opt out of it. Yes, customer support is very difficult if you do not have a default OS, and yes, it's hard when that default OS is not Windows, but couldn't you have customers sign a wavier stating they understand this request? Could you not send a CD with diag tools (Like DSET) along with No-OS computers and laptops? Example:
Dell Support: I see you have no OS shipped with this computer, do you have the DSET CD?
Customer: Yes I do
Dell Support: Can you run that CD and we can go over the results!
Customer: Thanks Dell support, your my hero!

This proposition is very important, and it is just a matter of client's respect, also applying the french law, and the contract you are providing...

The best would be of course to sell laptops without Windows, with choice of Linux or NO OS, but immediately Dell could respect the Eula.

So please, do not lead us to tribunal to get satisfaction and make it easy to have a refund of Windows when this OS is not used and CDs returned unopened, and stop to think we're stupid by pretending Windows is free or costs only 20 Euros...

This is difficult for Dell as they take a cut of the money that goes to Microsoft and have some others pay them for installing stuff along with Windows. The bottom line is they lose if they do not sell Windows. In a free market, they could drum up business for loading a few things with Linux but that is a smaller market. It has to be a long term plan to go Linux for Dell and it is a risk. Can a business that is struggling take a risk? Do they have to take the risk? That is tough.

Perhaps they could ad value by configuring for their hardware and adding kid filters like dansguardian and automatic updates or so to permit them to charge Linux customers something more than barebones prices. If Dell takes a $50 cut of Windows licences and $20 for other stuff, maybe they could charge $100 to install Linux. That would take the risk out, would it not?

OPTIONS are good and legally better. No OS should be option on all computers. Reduce price. I'll gladly sign waiver for no software support. That goes for many small businesses that have their own IT people. And those who have already purchased OS licenses from MS.

Don't follow the Music and Movie industry... there are plenty of other software and services than can better the computer experience, and people are willing to pay for. Forcing people to use windows doesn't increase the value of the computer, especially forcing people to use the latest OS like Vista that's full of bugs and incompatibilities.

Microsoft has it too easy. A step to give people choice will force Microsoft to rethink about putting out a product that's more finished and complete. Microsoft has literally no liability now, and they need to be forced and pressured. Their easy money have made window's stale.

If you bought a Windows Vista Dell machine,
but Vista isn't working for you, could Dell give a rebate coupon?
Instead of cash, Dell could give you a gift card for Dell purchases
- almost as nice as getting your cash back.


If for some reason you got nothing but trouble from your Vista Install:

BOYCOTT VISTA!

But if it works just fine for you, congratulations.

If you are using a new machine with new software and new devices, Vista should run just fine. It's all new.

If you don't have a problem with losing your rights on your computer, the DRM issues, older software / hardware incompatibilities (which are the fault of the 3rd party people who didn't make Vista Updated drivers / updates yet), or the slow performance without a top of the line graphics card, Vista should work just fine for you.

I am sure a lot of the Vista issues will get corrected in 6 months or a year or two, whenever Vista Service Pack 2 rolls out.

Until then, if your Vista is slow, you can probably fix it for under $500.

First, try doubling your RAM - Windows Vista works better with more RAM, no doubt about it. RAM is cheap.

Second, go out and get yourself a decent graphics card. It's not 2002 anymore, time to update your graphics.

NVIDIA GeForce 7950GT 512.

If you got 2GB to 4GB of RAM, and the new Graphics Card, and Vista is still to slow for you, maybe it's your hard drive?

Another easy $500 or less will get you up to up to speed.

A new SEAGATE 750 GB Hard Drive and a New SATA 3.0 Gbps controller card should get you going.
The faster SATA 3G/s interface, 7200 rpm, and 16 MB buffer is much faster than an old IDE drive.

And with 750 GB, you have room to spare for the Massive Windows Vista install, updates, patches, security fixes, MS Office 2007, office updates, Norton Virus Scanner, Norton Internet Security, and all the data, documents, and content you can load into it!


And if you got double the RAM,
the new graphics card,
faster hard drive and controller card,
and you think Vista is still running too slow for you,
well switch to www.Ubuntu.com .

If Linux just isn't for you,
then BUY the Dual Quad Core Apple Mac Pro.

I got a refund!
I recently bought a Dell machine in Germany and asked for a refund of Vista - and got it. See the whole story here. The original is in German but I translated it into English. Dell, you are on the right track -- keep going!
